Samarth Madan

Samarth is an India-qualified lawyer with five years of professional experience in dispute resolution and a deep-seated interest in international arbitration. 

Before joining the MIDS, he had worked for three years with the market-leading arbitration practice of Shardul Mangaldas & Co, Delhi, ranked on the GAR100 and in the top tiers of leading directories and publications. Prior to this and after being admitted to the Indian bar, he had also worked with the litigation team at Luthra & Luthra Law Offices, another highly renowned Indian law firm, for two years.

Samarth’s professional career has focused primarily on representing and advising clients in commercial arbitrations, seated in India and Singapore and administered ad-hoc or under institutional rules (ICC and SIAC). These disputes have stemmed from various industrial sectors, including construction, energy, oil and gas, real estate, manufacturing, event management, private equity, etc. He has also acted in disputes arising from joint ventures and shareholders’ agreements. Samarth has been active in arbitration-related court proceedings for interim measures, challenging the arbitrator’s mandate and annulment and enforcement of arbitral awards. Many of these matters have involved cross-border elements and complex issues of arbitration law.

Additionally, Samarth has advised a leading industry association in proposing amendments to the (Indian) Arbitration and Conciliation Act and the Mediation Bill for the consideration of parliamentary/expert committees constituted specially by the Indian Government. He has also taught courses on arbitration and mediation at leading Indian law schools. Samarth qualified as a Tribunal Secretary after clearing the Tribunal Secretary Training Program, organised by the Mumbai Centre for International Arbitration. He holds a first-class law degree and has won mooting laurels in India and abroad.
